Guest waiver and host agreement

When you book a pass you tick a box that says you accept the guest waiver. When you list your land you tick a box for the host agreement. This page is what those boxes mean. Daybird records the time you ticked.

Guest waiver (template)

I am booking a visit to private land through Daybird. I understand and agree that:

  1. I take on the risks of walking on private land. Fields, woods, shorelines and farm land have uneven ground, water, ice, fences, animals, machinery, ticks, hunting in season and weather that changes. I accept these risks for myself. I will not hold the landowner or Daybird responsible for an injury or loss that comes from an ordinary risk of being outdoors, except where the law says a waiver like this cannot apply.
  2. Nobody promises birds. The brief is a forecast and the listing is the host's best description. The birds may not show up. A quiet morning is not grounds for a refund or a complaint.
  3. I will follow the host's rules. I will arrive and leave within the listed window, park where I am told, stay on the paths or areas the host names, keep dogs home unless the listing allows them, and leave when asked.
  4. I will leave no trace. I will take out everything I bring in, close gates behind me, and not disturb livestock, crops, nests or roosts. I will not use playback or flush birds for a better look.
  5. I will keep the location private. The exact location and directions are shared with me to make the visit possible. I will not post or forward them, and I will keep sensitive species vague in anything public.
  6. I am 13 or older. If I am under 18, a parent or guardian is booking for me and will be with me on the visit.
  7. Daybird is a notice board. It introduces me to the host and records the booking. It does not inspect land, insure visits or guarantee anything about the host or the property.

Host agreement (template)

I am listing land I own or have the right to open to visitors. I understand and agree that:

  1. I have the right to invite people onto this land and I will keep the listing accurate about where visitors may go and what they may do.
  2. I will tell visitors what they need to know. I will list the rules, parking and meeting point, and warn about anything on the land a reasonable visitor would not expect, such as an electric fence, a bull, an open well or active logging.
  3. I decide who comes and when. I can cancel a booking, and I can ask anyone to leave. Daybird does not screen visitors beyond requiring a sign-in email.
  4. I understand the law may protect me, and may not. Many states, including New Hampshire, limit a landowner's liability to people allowed on the land for recreation free of charge. Charging a fee can change that. Before I charge for a pass I will ask an attorney and my insurer whether my coverage applies. [Attorney to confirm the current New Hampshire recreational-use statute and the effect of a fee.]
  5. I will keep visitors' details private. I see the display names of people who book so I know who to expect. I will not share them.
  6. Daybird is a notice board. It shows my listing, reveals my exact location only to people with a booking, and records bookings. It does not take payment yet, does not insure visits, and is not a party to the visit.

Recorded when you publish: the time you accepted this agreement, with your listing. Version [HOST_AGREEMENT_VERSION], dated [DATE].

Before the first paid pass

  • One-hour attorney consult: waivers for minors, landowner liability, New Hampshire's recreational-use law, and whether a fee changes the picture.
  • Ask an insurance agent about event or general liability cover for hosted mornings.
  • Record a version number for each document so a booking can be matched to the exact text the guest saw.
